1. Acceptance of Terms

By accessing and using the FlyBocas website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

FlyBocas is a platform that offers empty leg flights per seat in Panama. We are NOT a commercial airline or air carrier. We facilitate access to empty leg flights—repositioning flights that would otherwise fly empty when charter clients book one-way trips.

Key Service Characteristics:

• Flights are subject to availability and may be canceled or modified with limited notice
• Schedules depend entirely on primary charter bookings
• Service is opportunistic and availability-based
• Significant discounts are offered due to the nature of empty leg flights

3. Flight Availability and Changes

3.1 Subject to Primary Charter

All FlyBocas flights are dependent on the primary charter client’s booking. The primary charter client has absolute priority, and their changes directly affect your flight.

3.2 Potential Changes Include:

• Flight cancellation with limited or no advance notice
• Schedule changes (departure/arrival times)
• Route modifications
• Date changes
• Airport changes

3.3 Your Acknowledgment

By booking with FlyBocas, you acknowledge and accept that your flight may be canceled or significantly modified at any time due to changes made by the primary charter client.

4. Weather and Operational Conditions

4.1 Weather Dependencies

All flights are subject to weather conditions and may be:

• Delayed
• Rerouted
• Canceled for safety reasons

4.2 No Guarantees

FlyBocas cannot guarantee flight operations due to weather, mechanical issues, air traffic control restrictions, or other operational factors beyond our control.

5. Booking and Payment

5.1 Booking Confirmation

A booking is only confirmed upon receipt of full payment. Confirmation does not guarantee the flight will operate as scheduled.

5.2 Pricing

Prices are subject to change until payment is received and confirmed. Advertised prices reflect the discounted nature of empty leg availability.

5.3 Payment Terms

6. Cancellations and Refunds

6.1 Cancellations by FlyBocas

If a flight is canceled due to:

• Primary charter changes
• Weather conditions

6.2 Cancellations by Passenger

• Cancellations made 12 hours/days before departure: Full refund

6.3 Processing Time

Refunds will be processed within 3 business days.

7. Passenger Responsibilities

7.1 Documentation

Passengers must provide:

• Valid government-issued photo identification
• Any required travel documents
• Emergency contact information

7.2 Check-in Requirements

Passengers must:

• Arrive at the specified location at the required time
• Complete all check-in procedures
• Comply with all safety briefings and instructions

7.3 Conduct

Passengers agree to:

• Follow all crew instructions
• Behave appropriately and safely
• Not endanger the aircraft, crew, or other passengers
• Not be under the influence of drugs or alcohol

8. Baggage

8.1 Baggage Limitations

• Any indirect, consequential, or punitive damages resulting from flight delays, cancellations, or modifications

9.3 Maximum Liability

Our maximum liability is limited to the amount paid for your ticket.

10. Not a Common Carrier

FlyBocas is NOT a commercial airline or common carrier. We operate as an intermediary connecting passengers with available empty leg flights. The actual flight operations are conducted by licensed charter operators.

11. No Guarantees of Service

Due to the nature of empty leg flights:

• We make no guarantees of schedule reliability
• Flights may be canceled at any time
• Alternative transportation is the passenger’s responsibility
• We recommend not booking non-refundable connections or accommodations dependent on FlyBocas flights

12. Communication

12.1 Contact Information

Passengers must provide accurate contact information (phone number and email) and agree to:

• Monitor their contact methods regularly
• Respond promptly to communications from FlyBocas
• Update contact information if it changes

12.2 Notification of Changes

We will attempt to notify passengers of changes as soon as possible, but cannot guarantee advance notice.

13. Indemnification

You agree to indemnify and hold harmless FlyBocas, its operators, affiliates, and employees from any claims, damages, or expenses arising from your use of our services or violation of these terms.

14. Privacy and Data Protection

Your personal information will be handled in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your information as described.

15. Modifications to Terms

FlyBocas reserves the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

16. Governing Law

These Terms of Service are governed by the laws of the Republic of Panama. Any disputes shall be resolved in the courts of Panama.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms of Service constitute the entire agreement between you and FlyBocas regarding the use of our services.
